Faroese Court halts decision to send 15-year-old boy to institution in Denmark

The Faroese Court temporarily halted a decision last month to send a 15-year-old boy to an institution in Denmark, establishing a new precedent.
Annfinn V. Hansen, a lawyer representing the Faroese Complaints Board, has requested the Process Grant Board to examine the aspect of the case that could set a precedent for similar situations.
“I have inquired whether the Faroese Court has the authority to challenge the decision or not. This means that no further actions will occur until the Faroese Court has reviewed the case,” he stated.
So far, both authorities and the judiciary have believed there was no jurisdiction to halt a case. However, the Faroese Court has now indicated that such authority exists. The Child Protection Act states that this should not be permissible, which could have implications for other cases, depending on how this one unfolds.
While this case is fundamental for others, it does not impact the specific case of the 15-year-old boy, Hansen noted.
