Supreme Court approves young test buyers in kiosks

The Danish Supreme Court has ruled that Sikkerhedsstyrelsen may send young test buyers into kiosks to check whether alcohol, cigarettes or nicotine pouches are sold to people under 18, DR reports.

The court found that the practice does not violate the European Convention on Human Rights.

The case was brought by a kiosk owner from Als who was fined 25,000 kroner in 2024 for selling nicotine pouches to a 16-year-old test buyer sent by Sikkerhedsstyrelsen.

Both the district court and the High Court had previously ruled that the owner must pay the fine. The Supreme Court has now upheld that conclusion in a precedent-setting judgment.
