Man charged with rape and threatening minors released by Sør-Odal District Court in Norway

A man in his 50s has been charged with raping a 13-year-old girl and exhibiting sexually inappropriate behavior towards three girls under the age of 16. He has also been accused of threatening the girls. Previously convicted of various sexual offenses, he is currently in custody due to concerns about the high risk of reoffending. If found guilty, he could face indefinite detention.

A recent ruling from the Sør-Odal District Court highlights that the court continues to view the risk of reoffending as significant. An expert assessment indicates a considerable risk of new sexual offenses should the man be released. However, the court also acknowledges the man’s health issues, arguing that it would be disproportionate to keep him in custody until his trial in September.

Consequently, the court decided to release him, pointing to extensive health challenges the defendant discussed during the proceedings and previous detention hearings. The court remarked that the prosecution had not taken sufficient action to address the defendant’s situation.

The prosecution has appealed the ruling, meaning the man will remain in custody until higher courts review the case. His lawyer emphasized the fundamental principle in Norwegian law that inmates are entitled to adequate medical care and asserted that failure to meet minimum requirements necessitates releasing the inmate.

Concerns have been raised regarding the safety of the five minor victims involved in this case, as they had felt secure knowing the accused was in police custody since last September. The prosecution maintains that the defendant is receiving adequate health care in prison, while discussing possible transfers to facilities with better health care options.
