Supreme Court to review conviction of woman from Pori for aggravated sexual assault against a child

The Supreme Court has granted an appeal to a woman from Pori who was convicted by the Vaasa Court of Appeal for severe charges, including aggravated sexual assault against a child, aggravated sexual exploitation of a child, and unlawful restraint. The case involves a couple from Pori sentenced for a series of serious sexual and violent crimes against a minor that spanned from spring 2017 to summer 2021, lasting over four years.

Both individuals underwent mental health assessments during the trial. The Finnish Institute for Health and Welfare (THL) provided insights indicating that the defendants were of diminished responsibility at the time of the offenses, meaning they did not fully comprehend the implications of their actions. The district court accepted THL’s evaluation and sentenced the man to more than 11 years in prison, while the woman received a sentence of over 9 years.

However, the High Court interpreted the woman’s mental state differently. It determined that she was fully responsible for her actions when the crimes occurred, increasing her prison sentence to ten years. In contrast, the man’s sentence was reduced to ten years as well, with the court finding that he committed the offenses while experiencing diminished responsibility.

Now, the Supreme Court is set to review whether the woman should indeed be considered legally responsible for the crimes attributed to her, warranting a potential reassessment of her conviction by the lower court.
