Emma celebrates European Court ruling against Denmark in rape case

Emma expressed relief after receiving a ruling from the European Court of Human Rights, which determined that Denmark had violated her rights in a rape case. In 2021, she reported a man for rape to the Danish police, but due to administrative errors, the suspect was not brought to trial, including a mix-up involving an incorrect identification number. Consequently, the case became time-barred.

“This is completely insane. I’m absolutely happy, relieved, and proud that we’ve come this far. It has been an incredibly long process,” Emma stated. Due to the nature of the case, her full name has not been disclosed.

Emma took the matter to the European Court of Human Rights after facing significant resistance from the prosecution, the government, and the judicial system. She described the ordeal as exhausting but acknowledged the vital support she received from skilled individuals throughout the process.

The case has become a principled matter for her, as she hopes to prevent others from enduring similar mishandling in the legal system. “Those who come after me should never experience the treatment I received in our judicial system,” Emma emphasized. She hopes that authorities learn from this case, stating, “We are not just a case number on a piece of paper. We are people reporting these incidents, and I hope we will be treated as such moving forward.”

While the ruling does not change the fact that her case was not heard in a Danish court, Emma is hopeful that the changes spurred by her situation will benefit others. “Now I can hopefully close this chapter that I have been trying to close for three years, and then I will hug the amazing people who have supported me all the way,” she concluded.
