Court rules in favor of Samherji hf. against trademark infringement by Óddi Eysteinn in the UK

A court in the UK has ruled in favor of Samherji hf. regarding trademark infringements committed by an individual operating under the artist name Odee. The ruling, issued today, upheld all claims made by Samherji hf.
The case involved Óddi Eysteinn Friðriksson, who created a website that misrepresented itself as associated with Samherji, using a UK domain while misleadingly claiming to have the company’s authority. The website was designed to appear legitimate and spread false information, including an apology from Samherji regarding its operations in Namibia.
The court found that Óddi Eysteinn’s actions were prohibited and dismissed his defense of artistic expression. It emphasized that the use of Samherji’s trademark was intended to lend credibility to the site rather than to serve as a legitimate artistic critique. The court also noted that the website’s presentation was indistinguishable from an official company page, thereby failing to meet the standards of artistic satire that would fall under the protections of free speech.
The judge concluded that the setup of the website, including the adoption of the company’s name and the dissemination of incorrect information, indicated a willful intent to deceive. The ruling clarified that while freedom of expression is a right, it can be limited by the legal rights of others, such as trademark protections.
Thorsteinn Már Baldvinsson, CEO of Samherji, expressed satisfaction with the verdict, stating it affirms the distinction between legitimate artistic expression and exploitation of registered trademarks.
