Ostrobothnia police department faces charges for workplace safety violations in Kokkola

It is unusual for an entire police department to face charges for suspected workplace safety violations, according to emeritus professor of criminal law, Matti Tolvanen. Finnish public broadcaster Yle reported that the Ostrobothnia police department and four of its officers are being accused of neglecting safety measures related to an explosion incident that occurred over three years ago in Kokkola.

During a training event, two officers were injured when explosives intended for disposal detonated prematurely, with one officer suffering serious injuries and sustaining permanent damage, hindering his ability to return to former duties.

The prosecution is seeking a €15,000 fine for the Ostrobothnia police department for these workplace safety violations. According to Tolvanen, it is generally uncommon for public authorities to face collective fines in Finland, which are typically applicable in cases involving public organizations and safety or environmental violations.

The case is further notable due to multiple officers being prosecuted simultaneously for the safety infractions. Three officers are charged with workplace safety violations, causing bodily harm, and breach of duty, while one is charged solely with breach of duty. The charges highlight serious shortcomings in the explosion scenario, including inadequate safety measures, risk assessments, and training regarding protective equipment.

Tolvanen remarks that simply facing charges could impact the police’s reputation. The notion that police may have neglected safety regulations, poorly planned, or failed to anticipate risks, particularly concerning explosives, presents a troubling image. The main court proceedings are expected to take place at the end of the year, with a preparatory session held in Kokkola this week.
