Vaasa Court of Appeal suspends enforcement of district court ruling against legal assistant in Finland

The Vaasa Court of Appeal has decided to suspend the enforcement of a district court ruling that prohibited a legal assistant from representing clients. This decision came after the district court ruled last week that the assistant would be banned until January 1, 2026. The legal assistant’s actions were deemed dishonest or at least incompetent, leading the district court to conclude that they were unfit for the role.

This case is quite unusual. The legal assistant had previously received a warning from the Finnish Bar Association’s supervisory board regarding their conduct but continued to practice nonetheless, even violating accessibility requirements.

After the district court’s decision, the legal assistant appealed, seeking a change to the ruling and requesting a suspension of its enforcement. The grounds for this appeal were that the district court’s decision was incorrect, and one of the judges involved was disqualified.

The Court of Appeal’s ruling on Tuesday will remain in effect until the court resolves the main issue or provides further directives. Consequently, the district court’s decision regarding the prohibition from representing clients will not be enforced for the time being.
