Complaints board dismisses Skeiða- and Gnúpverjahreppur’s challenge against Búrfell wind power project license

The Environmental and Resource Affairs Complaints Board has dismissed a complaint from the Skeiða- and Gnúpverjahreppur municipality regarding a license for a wind power project at Búrfell. The board determined that local authorities do not have the power to appeal decisions made by other governmental entities unless explicitly stated in law.

Skeiða- and Gnúpverjahreppur’s municipal council challenged the validity of the parliamentary decision that classified Búrfellslund under a utilization category in June 2022. They argued that the processes followed by both the Planning Agency and the National Energy Authority were inadequate.

The municipality has consistently objected to the proposed developments throughout the entire process leading up to this point. Local officials argue that before establishing Iceland’s first wind power plant, it is essential to finalize policies concerning wind energy and revenue sharing between the state and municipalities.

In response to the board’s ruling, the municipality’s representative expressed disappointment and surprise. Further discussions are planned, particularly as they await a decision from a related case concerning an appeal filed by Nature Guardians regarding a license granted for a different wind project in the Rangárþing ytra area.

The board also rejected Nature Guardians’ request to halt construction activities related to the wind power project while their appeal is under consideration. These ongoing debates reflect broader tensions between environmental considerations and energy development agendas in Iceland.
