Government representative reviews fishing regulations on Faroe Bank after complaint from company

The regulations governing fishing on the Faroe Bank in the previous year have been deemed insufficiently articulated.

The government representative has reviewed a complaint regarding the “temporary special arrangement for fishing demersal fish on the Faroe Bank in 2023.”

The complaint stems from a company and its vessel in group 5 being barred from fishing in that area this year.

The complainant argues that the regulation was unjust, unreasonable, and discriminatory. They reference provisions 1 and 2 of the maritime law as the legal basis for the regulations.

The representative notes that when the Parliament explicitly outlined a special provision for the Faroe Bank under section 2, conventional legal interpretation suggests that section 1 does not apply to the Faroe Bank.

Furthermore, the representative points out that the regulation employed the term “fishing license” in a manner different from its definition in the parliamentary legislation.

The representative advises the Ministry of Fisheries and Transport to reconsider the inclusion of section 1 as a legal basis in the regulations concerning the Faroe Bank and to ensure that any regulations grounded in maritime law adhere to the stipulated definitions and principles governing fishing and fishing licenses set forth by the maritime legislation.
