Police officer criticized for pepper spray use on Artesh Salim Ibrahim in Vejle, Denmark

In a recent ruling by an independent oversight agency, a police officer from the Southeast Jutland Police has faced criticism for using pepper spray on Artesh Salim Ibrahim during an arrest in Vejle back in November 2021. The agency characterized the action as unnecessary, excessive, and disproportionate.

The incident, which took place on November 8, 2021, is featured in a 2023 documentary that follows a Syrian family in Vejle and their repeated encounters with law enforcement. On that day, police officers arrived at the family’s residence while searching for two individuals, leading to a confrontation that resulted in the arrest of two brothers, during which pepper spray was deployed. While one brother’s complaint was dismissed, the other was upheld, acknowledging that the use of pepper spray was questionable in his case.

The oversight agency raised concerns because, in its view, Ibrahim was not resisting arrest at the time pepper spray was used. Previously, two officers had faced charges for using excessive force, but the prosecution later dropped the case.

The family’s video documentation played a crucial role in the agency’s findings. A police researcher noted that it is uncommon for the oversight body to criticize police conduct, making this ruling significant. He observed a stark contrast between the police’s account and that of the family during the incident.

The police representative expressed surprise at the criticism, arguing that the use of pepper spray could be justified under the circumstances. Nevertheless, the police department acknowledged the ruling. The officer’s lawyer has requested a review of the decision, arguing that the situation regarding passive resistance was not adequately considered. The family, meanwhile, expressed satisfaction with the oversight body’s findings, although they remain puzzled that the officer faced criticism without facing any disciplinary action.
