Court overturns villa seizure of Jyrki Hallikainen in Ruka, Finland

The Rovaniemi Court of Appeals has overturned the decision to seize the villa of Jyrki Hallikainen, founder of technology company Uros, located in Ruka, according to local newspaper Kaleva. The bailiff had previously linked the property to a financial arrangement with Faubourg Oy, a company based in Oulu, of which Hallikainen is the chairman.
The court determined that the acquisition of the villa under Faubourg Oy’s name was not intended to evade debt payments. In general terms, the case arose when the bailiff decided in early 2023 to confiscate the villa due to debts owed by Hallikainen’s Uros company. The bailiff argued that the financing for the property and its renovations came from Hallikainen, who also used the villa.
According to the bailiff’s view, Faubourg’s ownership of the property was merely nominal. Faubourg appealed to the Oulu District Court, which upheld the previous decision. The company then took the matter to the Court of Appeals, which ultimately ruled in favor of Faubourg.
The Rovaniemi Court of Appeals noted that Hallikainen had financed Faubourg Oy with around seven million euros and had provided even greater sums to Uros Oy. Uros’ operations collapsed in 2021 due to insolvency, leaving Hallikainen unable to repay bank claims based on company loan guarantees.
The court concluded that the acquisition of the villa in 2012 under Faubourg’s name was not a significant factor in Hallikainen’s creditors facing challenges in collecting debts. It emphasized that there was insufficient evidence to show that the acquisition was intended to avoid debt repayment or conceal Hallikainen’s assets from creditors.
