Kims owner loses court case over cheese puff definition

Orkla Snacks Denmark, which owns the Kims snack brand, has lost a court case over the definition of the Danish word for cheese puff, DR reports.

The Danish Dictionary will continue to define an ostepop as a “crispy, yellow or orange, curved snack made from corn flour and flavoured with cheddar cheese”.

Orkla Snacks Denmark had sued the Danish Society for Language and Literature, which publishes the dictionary, arguing that the definition should state that the snacks are sold under Kims’ trademark Ostepops.

The Maritime and Commercial Court rejected the claim. The court said the dictionary’s publisher could not be required to change the definition.

The dictionary already notes under the definition that the plural form Ostepops is a registered trademark. The court found that this complies with the relevant provision of the Danish Trademark Act, which requires registered trademarks to be identified.

Orkla Snacks must pay 65,000 kroner in legal costs and has four weeks to appeal the ruling.
