Court reviews erroneous footage in sexual assault case against Arne Bye in Norway

A court recently viewed footage related to a case against a medical professional accused of committing sexual assault on patients during gynecological examinations. However, tensions arose when both the defendant and his legal team expressed concerns about the authenticity of the individuals depicted in the video. Shortly after the video was played, a prosecutor confirmed that it did not feature the correct patient, prompting an apology for the error.

The defendant, Arne Bye, faces charges concerning the sexual assault of 87 patients, alongside accusations of abusing his medical position for inappropriate interactions with 94 women between 2004 and 2021. Bye has admitted guilt in connection with three of the assaults and 35 instances of misconduct linked to his professional role.

Following the screening of the erroneous video, Bye’s defense attorney pointed out discrepancies between the footage and patient records, leading to further scrutiny. Prosecutor Eli Nessimo highlighted the misidentification, noting that it raised significant questions during the proceedings. Consequently, the judge ordered a brief recess to reassess the situation.

As the case progresses, the prosecution aims to ensure the integrity of the visual evidence presented, which amounts to approximately 6,000 hours of material. Both prosecutors and investigators have committed to taking measures to prevent similar mistakes in the future.

The session continued with the correct footage shown later on, depicting incidents involving Bye. He also partially admitted to misconduct concerning one victim, describing his actions in court as regrettable. The notion of wrongful accusations has emerged previously in similar cases tied to this ongoing investigation, underscoring the ongoing complexities surrounding the case.
