Supreme Court dismisses Reykjavík’s claim against the state over Municipal Equalization Fund

The Supreme Court of Iceland has ruled in favor of the state, dismissing a significant claim from the city of Reykjavík related to funding from the Municipal Equalization Fund. This fund plays a crucial role in supporting the operation of primary schools and providing education for children learning Icelandic as a second language.

Nearly a year prior, the District Court of Reykjavík ordered the state to pay the city around 3.5 billion krónur, along with interest. The court found that Reykjavík had been unlawfully excluded from the fund’s allocations due to a regulation set forth by the Minister. The city sought a total of approximately 5.5 billion krónur in claims.

The state appealed the District Court’s decision to the Supreme Court, which has since cleared the state of the claims, stating that the regulation issued by the Minister was indeed legally justified.
