Conditional prison sentence for minor in Ylitornio, Finland for child rape

A conditional prison sentence handed down for the rape of a child has come as no surprise to criminal law professor Kimmo Nuotio. The Lapland District Court sentenced a minor to a year and ten months in conditional imprisonment for the rape of a 13-year-old schoolmate. Nuotio emphasizes that the sentence would have been much harsher if the perpetrator had been an adult.

“It’s clear that if the perpetrator had been of legal age, this would have resulted in a significant prison sentence, typically ranging from 3 to 4 years, or possibly longer,” he stated. In Finland, sending minors to prison is quite rare; as of early November, only five minors were serving sentences in Finnish prisons. Additionally, there are minors in pre-trial detention.

To address juvenile crime, Finnish authorities combine criminal sanctions with child protection measures, which can also be substantial. Nuotio notes that the threshold for incarcerating those under 18 is set quite high, aiming to avoid imprisonment when there is hope for the individual to reform. “During adolescence, individuals are still in a crucial phase of personality development; there is still potential for learning and adopting responsible behavior,” he explained.

However, rape of a child is a severe crime, and the Lapland District Court did consider imposing an unconditional sentence. The court ultimately favored a conditional sentence, citing the lack of prior criminal history and absence of a criminal attitude exhibited by the minor. The conditional sentence was imposed at nearly the maximum severity, and had it exceeded two years, it would have been automatically unconditional.

The court’s ruling has not yet become final, as there is an option to appeal to the court of appeal. In addition to the conditional prison sentence, the 16-year-old perpetrator was sentenced to 60 hours of community service and ordered to pay over €21,000 in damages. The incident took place during a school day at Ainiovaara School in Ylitornio last December.
