Homeowners seek court ruling over dike dispute in Diernæs Strand, Denmark

Over 50 summer home owners from Diernæs Strand near Haderslev are seeking a court ruling to confirm that they do not reside on the wrong side of a dike. Following a storm surge in October 2023, they all received denials for compensation from their insurance companies. The rejections were based on an assessment by the Coastal Directorate, which concluded that the summer homes were inadequately protected as they lie between the sea and a dike—though locals argue it is merely an earthen mound without any coastal protection purpose.

“We feel we have been treated very poorly,” stated Verner Christiansen, head of the local summer homeowners’ association. With no possibility to appeal the decisions, the homeowners now feel their only recourse is to sue the state. Christiansen expressed frustration, suggesting this situation is shameless, and noted they will indeed pursue legal action.

The homeowners believe they have a chance of success, partly due to the Coastal Atlas, which indicates registered sea dikes across Denmark intended to protect against storm surges. The dike in question at Diernæs Strand is not included in this atlas, which the homeowners argue is a point in their favor should they proceed with legal action. However, the Coastal Directorate has maintained that the atlas is merely advisory.

Frederik Waage, a law professor at University of Southern Denmark, cautioned that suing the government often presents significant challenges. He estimated that the homeowners could incur costs exceeding one million kroner, which they may never recover. Still, Waage emphasized the importance of pursuing justice if they believe they are right.

Under the storm surge law, compensation can be denied if property is located outside of a dike, which has resulted in the denial of claims for these homeowners. Verner Hansen, one of the affected residents, underscored the urgency of initiating the lawsuit to avoid the possibility of it becoming time-barred.
